This Privacy Policy explains how Emer, Inc. (the "Company", "we" or "us") collects, uses, discloses, and safeguards your information when you use our website, available at heyemer.com, and via other surfaces, including, without limitation, APIs (collectively, the "Services"). By using the Services, you agree to this Privacy Policy; provided that to the extent the Company is acting as a "business associate" under the Health Insurance Portability and Accountability Act of 1996, our handling of "Protected Health Information" (as defined therein) is subject to the Business Associate Agreement (the "BAA") between you and us, and the BAA controls to the extent of conflicts between the BAA and this Privacy Policy.

By providing us with such information, you warrant and represent that you have obtained all requisite consent and authorization required under law to share such information (including Protected Health Information) with us. We are responsible for your failure to obtain lawful authorization to disclose information with us.

Service Data

We collect the data submitted through the Service and the content of your interactions when you use the Services (collectively, "Service Data").

Technical and Usage Data

While we strive to use commercially acceptable means to protect your data, we cannot guarantee its absolute security.

8. Age Limitations

To the extent prohibited by applicable law, we do not allow use of our Services by anyone younger than 16 years old. If we learn that anyone younger than 16 has unlawfully provided us with information, we will take steps to delete such information.

9. Identifying the Data Controller and Processor; International Data Transfers

Data protection law in certain jurisdictions differentiates between the "controller" and "processor" of information. In general, you are the controller of Service Data and we are the processor of Service Data and the Controller of other data subject to this Privacy Policy.
